NO PURCHASE NECESSARY.
1. GENERAL: Contest is sponsored by OurStage, Inc. (“OurStage”), P.O. Box 182,
Chelmsford, MA, 01824, Superfly Productions, 64 W. 3rd St., Suite 205, New York, NY
10012, and Bowery Presents, 6 Delancey St., New York, NY 10002 (collectively
“Sponsors”). The geographic scope of this Contest is the 48 contiguous United States
(excludes Alaska and Hawaii). Contest is subject to all federal, state and local laws.
Other restrictions apply. Void where prohibited by law. By entering, participants agree to
these Official Rules, OurStage’s Privacy Policy (available at www.OurStage.com) and
the decisions of Sponsors and Contest Judges, which are binding in all respects.
2. CONTEST PERIOD: Contest begins at 6:00:00 a.m. Eastern Time ("ET") on June 25,
2009 and ends at 12:01:00 a.m. ET on July 31, 2009 ("Contest Period"). Final entry
deadline is July 22, 2009 at 11:59:59 pm ET or whenever 3,000 contest entries have been
received, whichever occurs first.
3. ELIGIBILITY: Open to OurStage account-holders who are thirteen (13) years of age or
older and reside in any of the 48 contiguous United States (excludes Alaska and Hawaii)
at the time of entry. If you are under the age of eighteen (18), you will also need written
parental consent to participate or to claim a prize. Not eligible to participate are
employees, contractors, directors and officers of Sponsors, each of their respective
parent, subsidiaries and affiliated companies, distributors, web design, advertising,
fulfillment, judging and Contest agencies involved in the administration, development,
fulfillment and execution of this Contest (collectively, "Contest Parties"), and the
immediate family members of each (spouse, parent, child, sibling, grandparent, and
spouse or "step" of each) and those living in their same households (those persons
whether related or not who live in the same residence for at least three months during the
twelve-month period preceding the start date of the Contest).
4. GRAND PRIZE (1): One (1) Grand Prize Winner will win the opportunity to perform
for at least thirty (30) minutes at Terminal 5 at John F. Kennedy’s International Airport,
the opportunity to perform at Bowery Presents’ Terminal 5 (or another Bowery Presents’
venue, at the discretion of Bowery Presents) and two (2) round-trip coach class air
transportation Travel Vouchers, each good for one passenger (one issued in the name of
Grand Prize Winner and one for his/her Guest) valid for travel between any two
destinations in the JetBlue route network for one (1) year from date of issuance. In the
event the Grand Prize Winner does not reside in the New York City area, on or about the
date of Winner’s scheduled performance, the Winner will be provided with round-trip
coach class air transportation on JetBlue from the destination city served by JetBlue
nearest to the Winner’s residence to John F. Kennedy Airport. Approximate Retail Value
(“ARV”): $598.00. Only Entrants who are not JetBlue employees are eligible to win the
Grand Prize.
5. FIRST PRIZE (4): First Prize consists of the opportunity to perform for at least thirty
(30) minutes at Terminal 5 at John F. Kennedy International Airport. In the event a First
Prize Winner does not reside in the New York City area, on or about the date of such
Winner’s scheduled performance, such Winner will be provided with round-trip coach
class air transportation on JetBlue from the destination city served by JetBlue nearest to
such Winner’s residence to John F. Kennedy Airport. First Prize has no retail value
($0.00). Only Entrants who are not JetBlue employees are eligible to win a First Prize.
6. CREWMEMBER PRIZE (1): One (1) Crewmember Prize Winner will win the
opportunity to perform for at least thirty (30) minutes at Terminal 5 at John F. Kennedy’s
International Airport, and two (2) round-trip coach class air transportation Travel
Vouchers, each good for one passenger (one issued in the name of Crewmember Prize
Winner and one for his/her Guest) valid for travel between any two destinations in the
JetBlue route network for one (1) year from date of issuance. In the event the
Crewmember Prize Winner does not reside in the New York City area, on or about the
date of the Winner’s scheduled performance, the Winner will be provided with round-trip
coach class air transportation on JetBlue from the destination city served by JetBlue
nearest to the Winner’s residence to John F. Kennedy Airport. Approximate Retail Value
(“ARV”): $598.00. Only participants who are employees of JetBlue at the time of entry
and at the time of prize redemption and who enter the Contest through
www.OurStage.com/go/jetbluecrew the (“Crewmember Contest Page”) are eligible to
win a Crewmember Prize.
7. TRAVEL PRIZE RESTRICTIONS: Travel Voucher prizes are valid for one (1) year
from date of issuance, and all travel must be completed on or before the expiration date
as it appears on each Travel Voucher. Redeemed travel is subject to availability and seats
may not be available on all flights. Travel may be capacity controlled and space is
limited. Certain restrictions and blackout dates may apply, which may include a Saturday
night stay, all of which are subject to change at the sole discretion of JetBlue. Schedules
are subject to change without notice. Use of Travel Vouchers is subject to additional
terms and conditions, and other restrictions may apply. Sponsors, Contest Parties and
JetBlue are not liable for any expenses incurred as a consequence of a flight cancellation
or flight delay. Passengers are solely responsible for obtaining all necessary
documentation, travel authorizations, and travel insurance, if any. JetBlue reserves the
right to deny boarding to passengers without the proper documentation. Redemption of
Travel Vouchers at a JetBlue airport ticket counter is not allowed. Lost Travel Vouchers
cannot be replaced. Redeemed travel is not eligible for TrueBlue points and may not be
used toward the purchase of a JetBlue Getaways Vacation Package or a JetBlue Cruise.
TrueBlue is JetBlue’s flight gratitude program. Passengers using Travel Certificates are
subject and entitled to all provisions of the JetBlue Airways Contract of Carriage, except
denied boarding compensation and the Passenger Bill of Rights. The JetBlue Airways
Contract of Carriage is posted at http://www.jetblue.com/p/jetblue_coc.pdf.
8. PERFORMANCE PRIZE RESTRICTIONS: The exact time, location and duration of
stage time for the Prize Winners’ performance at Terminal 5 will be communicated to
such Prize Winners. Prize Winners’ performance and appearance, including lyrics,
clothing and behavior, should be family-friendly and must comply with all content
restrictions applicable to the entry materials set out below in paragraph 13. Prize
Winners are subject to all terminal rules established by JetBlue or the TSA and failure to
comply with such rules may result in immediate expulsion from the venue. Prize does
not constitute an employment or talent contract or other contract of any kind. Prize
Winners agree not to do anything that would be an offense involving moral turpitude, a
violation of federal, state or local laws, anything that brings Sponsors or JetBlue into
public dispute, contempt, scandal or ridicule, or anything that insults or offends the
community or any substantial group thereof or Sponsors’ or JetBlue’s products or
services. JetBlue or Bowery Presents (as applicable) shall have the right to review the
intended performances by the Prize Winners in advance of the stage time. JetBlue or
Bowery Presents (as applicable) shall have the right to cancel the performance of any
Prize Winner if it deems such performance to be lewd, indecent, obscene, scandalous, or
otherwise not in keeping with the family-friendly atmosphere of the venue.
9. OTHER PRIZE RESTRICTIONS: Prizes are not redeemable for cash and may not be
transferred or substituted, except that Sponsors and JetBlue reserve the right to substitute
a prize of comparable or greater value if they deem necessary. Prizes cannot be sold,
bartered or traded on auction websites. Prize Winners are solely responsible for any
applicable fees, service charges, surcharges or passenger facility charges, and all
insurance, federal, state and local taxes, if any, and any other unspecified expenses
associated with acceptance or use of prize not explicitly outlined above, including
without limitation, hotel accommodations, meals, beverages, tips, gratuities, sightseeing,
souvenirs, ground transportation, incidentals and other expenses, and except as expressly
provided herein transportation to and from, and parking at, the John F. Kennedy Airport
or any other performance venue. Any portion of any prize not used by any winner is
forfeit and no cash substitute will be offered or permitted. All prizes being offered are
provided “as is” with no warranty or guarantee either express or implied by Sponsors or
JetBlue. Sponsors and JetBlue have not made, and they are not responsible or liable for,
any warranty, representation, or guarantee, express or implied, in fact or in law, relative
to any prize, including but not limited to its quality, mechanical condition or fitness for a
particular purpose. Other restrictions apply.
10. ENTRY PERIOD: Entries will be accepted starting at 12:00:00 am ET June 24, 2009
and ending when 3,000 entries have been received or at 11:59:59 pm ET July 22, 2009,
whichever occurs first (“Submission Period”). To enter, you must first create a free
account by logging on to www.OurStage.com/go/jetblue (for JetBlue employees, visit
www.OurStage.com/go/jetbluecrew) (collectively referred to as the "Web Site"). Once
you have created your free account, log in and visit the Home Page (JetBlue employees
should visit www.OurStage.com/go/jetbluecrew), then click on the word "Upload" at the
top of the page. This will bring you to a page that will allow you to upload your entry
material. Subject to the Submission Requirements below, you may enter a unique
musical piece within the JetBlue's Terminal 5 Channel (each an “Entry”). No Entries will
be returned. As part of the Entry Process, each Entrant will be required to create a
profile. Limit one (1) Entry per person.
11. GROUP SUBMISSIONS: If any group of individuals elects to collaborate on an Entry,
they are required to designate one (1) person as the agent of the group to enter the
Contest, agree to these rules and accept the prize on behalf of the group. Neither
Sponsors, Contest Parties nor JetBlue are liable for any disputes between collaborators
arising under or related to the Contest.
12. SUBMISSION REQUIREMENTS: All Entries must satisfy the following
requirements (collectively referred to as “Submission Requirements“) in order to be
eligible for judging:

Technical Requirements
Each Entry must be at least thirty (30) seconds and no longer than fifteen (15) minutes in
length and be submitted in one of the formats allowed on the Upload/Compete page on
the Web Site. Visit www.ourstage.com/go/jetblue for more information on allowable
formats.
Content Requirements
• Entry must be:
- Original works.
- Scaled down acoustic instrumentation that does not include drums. Any
entry that involves drums tracks will be removed from the competition.
- Demo versions are accepted.
- One of the following genres: Folk, New Folks Jazz, R&B, Indie Rock
Acoustic, Singer Songwriter (female) or Singer Songwriter (male).
• Entry shall not contain infringing, unlawful, harmful, tortuous, defamatory,
libelous, obscene, invasive of the privacy of another person, threatening,
harassing, abusive, hateful, racist, infringing, pornographic, violent or otherwise
objectionable or inappropriate as determined by OurStage.
• Entry shall not include any personal information about any individual.
• Entry shall not include any material that attempts to impersonate any person or
organization, including without limitation, the personnel of OurStage.
• Entry shall not include any material that misrepresents an affiliation with another
person or organization.
• Entry shall not include any material that infringes any copyright, trademark,
patent, trade secret or other intellectual property right of a third party, or the
privacy/publicity rights or contractual rights of any other individual or entity.
• Entry shall not include any material that contains business solicitation of any type,
including advertising a product or service, offering a product or service for sale,
or directing readers to a location for more information about a product or service.
• Entry shall not include any material that contains any software, files or links to
other sites, viruses, corrupted files, or any other similar software or programs that
may adversely affect the operation of, or any feature of, the Web Site.
• Entry shall not include any material that attempts to modify in any way any
specifications, technology or application codes provided by OurStage or as
embedded in the Entry unless expressly authorized in writing by OurStage.
Entries that do not include all required information and adhere to the foregoing
Submission Requirements and otherwise comply with these Official Rules will be
considered void and will not be considered in this Contest.
13. NO OBLIGATION TO POST OR SCREEN ENTRIES: BY SUBMITTING AN
ENTRY, ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY MAY BE POSTED
ON THE WEB SITE, IN SPONSORS' DISCRETION. Sponsors reserve the right, but
not the obligation, to monitor/screen entries prior to posting them to the Website. By
entering, you acknowledge that Sponsors have no obligation to use or post any Entry you
submit and that Sponsors may, in their sole discretion, remove, delete and/or disqualify
Entries deemed to be inappropriate or otherwise non-compliant.
14. LICENSE: Submission of an Entry grants Sponsors and JetBlue and their agents an
unlimited, worldwide, perpetual, license and right to publish, use, publicly perform the
Entry in any way, in any and all media, without limitation, for purposes of Contest
fulfillment, administration, promotion, and public voting, without consideration to the
Entrant. By submitting an Entry, Entrant agrees never to sue or assert any claim against
the Sponsors or JetBlue arising out of such use of the Entry.
15. WARRANTIES & REPRESENTATIONS BY ENTRANT: By submitting an Entry,
each Entrant warrants and represents that (a) the Entry is Entrant’s own original work, (b),
the Entry does not infringe upon the copyrights, trademarks, rights of privacy, publicity or
other intellectual property or other rights of any person or entity; (c) that the Entrant has
obtained permission from any person whose name, likeness or voice is used in the Entry and
can make written copies of such permission(s) available to the Sponsors and JetBlue
upon request, and (d) and that publication of the Entry via various media (including on
the Web Site), will not infringe on the rights of any third parties.
16. INDEMNIFICATION: By submitting an Entrant, each Entrant agrees to indemnify and
hold Sponsors, Contest Parties and JetBlue and their respective affiliates, officers,
directors, agents, co-branders or other partners, and any of their employees (collectively,
the "Contest Indemnitees") harmless from any and all claims, damages, expenses, costs
(including reasonable attorneys' fees) and liabilities (including settlements), brought or
asserted by any third party against any of the Contest Indemnitees due to or arising out of
the Entrant’s breach of his or her warranties or representations in the preceding
paragraph, including but not limited to trademark, copyright, or other intellectual
property rights, right of publicity, right of privacy or defamation.
17. USER TERMINATION/NO OWNERSHIP: You understand and agree that you have
no ownership rights in your account or other access to the Web Site or features therein.
OurStage may cancel your Account and delete all Entries associated with your Account
at any time, and without notice, if OurStage deems that you have violated these Terms,
the Submission Rules, the law, or for any other reason. OurStage assumes no liability for
any information removed from our Web Site, and reserves the right to permanently
restrict access to the Web Site or a user Account.
18. NO CONFIDENTIALITY: By posting an Entry, you understand and acknowledge
that the nature of this Web Site is interactive and public and therefore, any materials,
ideas or other communications you transmit in any manner and for any reason will not be
treated as confidential or proprietary.
19. SELECTION OF WINNERS: There are three (3) rounds of voting to determine the
Winners for the Contest.
Regular Judging: All eligible Entries will be posted on the Web Site. There will be a
public vote online ("Judging") to determine the top twenty (20) Entries from the Contest
starting on July 1, 2009 at 12:00:00 am ET and ending July 24, 2009 at 11:59:59 pm ET.
Members of www.OurStage.com will be asked during this Judging process to rank an
Entry compared to another Entry or Entries. The top twenty (20) Entries in the Contest
will be determined based on this Judging using proprietary ranking algorithms.
Semi Finals: Once the top twenty (20) Entries for the Contest have been selected, there
will be a second Judging process within the top twenty (20), starting on July 25, 2009 at
12:00:00 am ET and ending on July 28, 2009 at 11:59:59 pm ET (the "Quarter Finals
Voting Period") to determine the top ten (10) artists (the “Top 10”) for the Contest.
IMPORTANT NOTE: Although the Judging process will continue after the Top 10
artists have been selected, and each of the Top 10 artists will be ranked by public
vote on the Web Site, this ranking WILL NOT determine the winners of the
Contest. Determination of which artists within the Top 10 will be selected as
winners of the Contest will be conducted as set forth below in “Final Winner
Selection.”
Online Judging Restrictions: Automated methods of voting are strictly prohibited. One
account per person/email address. Judging or entering through multiple accounts is
strictly prohibited. Any attempt by entrant and/or his/her family/friends to vote more than
the number of times authorized using multiple names or email address and/or any other
fraudulent mechanism, as determined by Sponsors in their sole discretion, shall give
Sponsors the right to disqualify entrant in their reasonable discretion.
Final Winner Selection: On or about August 1, 2009, Sponsors will convene a panel of
qualified judges (“Contest Judges”) to select four (4) non-JetBlue winners from among
all entries within the Top 10, and one (1) JetBlue employee from among all eligible
entries received. All winners are based on the following equally weighted criteria:
• Creativity
• Originality
• Musicality
• Vocal ability
• Completeness of profile (photographs, bios, other songs and/or videos)
Subject to verification of eligibility, the non-JetBlue entry with the highest score in the
Final Winner Selection shall be declared the Grand Prize Winner and the four (4) non-
JetBlue entries with the next highest scores will be declared the First Prize Winners.
Subject to verification of eligibility, the JetBlue employee entry selected in the Final
Winner Selection shall be declared the Crewmember Prize Winner. In the event of a tie,
the entry with the highest score in the “Musicality” category shall be declared the Prize
Winner. Entrants agree that the Sponsors have the sole right to decide all matters and
disputes arising from this Contest and that all decisions of Sponsors and the Contest
Judges shall be final and binding in all regards.
20. NOTIFICATION OF WINNERS: Prize Winners (or the Prize Winner’s parent/legal
guardian if the Prize Winner is a minor under the laws of the jurisdiction in which the
Prize Winner resides) will be notified by phone and/or mail and/or electronic mail and
will be required to complete, sign, notarize and return an Affidavit of Eligibility/Liability
Release, and, where lawful, a Publicity Release, within five (5) days of attempted
notification or Prize may be forfeited. In the event any prize is unclaimed, or if any prize
notification or any prize is returned as undeliverable, the prize will be forfeited and
awarded, subject to verification of eligibility, to the non-winning Entry with the next
highest score in the Final Winner Selection.
21. CORRECTION OF ERRORS/STATED NUMBER OF PRIZES: Sponsors reserve
the right to correct typographical or clerical errors in any Contest-related materials. No
more than the stated number of prizes will be awarded. In the event that production,
technical, seeding, programming or any other reasons cause more than the stated number
of prizes as set forth in these Official Rules to be available and/or claimed, Sponsors
reserve the right to award only the stated number of prizes from among all legitimate, un-
awarded, eligible prize claims in accordance with the foregoing judging criteria.
22. CANCELLATION: If for any reason the Contest is not capable of running as planned,
including infection by computer virus, bugs, tampering, unauthorized intervention, fraud,
technical failures, or any other causes which corrupt or affect the administration, security,
fairness, integrity or proper conduct of the Contest, Sponsors reserve the right, at their
sole discretion, to disqualify any individual who tampers with the entry process, and to
cancel, modify or terminate the Contest or any part of the Contest.
23. CHOICE OF LAW: This Contest is governed by the laws of the Commonwealth of
Massachusetts, with venue in Middlesex County, Massachusetts, and all claims must be
resolved in the federal or state courts located in Middlesex County, Massachusetts.
24. WAIVER: Any waiver of any obligation hereunder by Sponsors does not constitute a
general waiver of any obligation to entrants.
25. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is
assumed by Sponsors, Contest Parties or JetBlue resulting from any user's participation in
or attempt to participate in the Contest or ability or inability to upload or download any
information in connection with participating in the Contest. No responsibility or liability
is assumed by the Sponsors, Contest Parties or JetBlue for technical problems or
technical malfunction arising in connection with any of the following occurrences which
may affect the operation of the Contest: hardware or software errors; faulty computer,
telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other
online communication problems; errors or limitations of any Internet service providers,
servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any
e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail
transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic
congestion on the Internet or the Web Site; unauthorized human or non-human
intervention of the operation of the Contest, including without limitation, unauthorized
tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest,
or loss, miscount, misdirection, inaccessibility or unavailability of an email account used
in connection with the Contest. Sponsors, Contest Parties and JetBlue are not responsible
for any typographical errors in the announcement of prizes or these Official Rules, or any
inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own
risk. Sponsors, Contest Parties and JetBlue are not responsible for any personal injury or
property damage or losses of any kind which may be sustained to user's or any other
person's computer equipment resulting from participation in the Contest, use of the Web
Site or the download of any information from the Web Site. By participating in the
Contest, Entrant (or their parent/legal guardian if an eligible minor under the laws of the
jurisdiction in which the Entrant resides) agrees to release and hold Sponsors, Contest
Parties and JetBlue harmless from any and all claims, damages or liabilities arising from
or relating to such Entrant's participation in the Contest, acceptance or use of any prize,
including any travel related thereto, or any use of Entry.
26. PUBLICITY RELEASE: By accepting a prize in the Contest, winners (or their
parent/legal guardian if minors under the laws of the jurisdiction in which the winner
resides) agree that Sponsors and JetBlue have the right to use winner's name, Entry and
biographical information for advertising/promotional purposes, except where prohibited
by law.
27. WINNERS' LIST/RULES REQUEST: For Winner’s List (available after September 1,
2009) or Official Rules, send your request with a self-addressed, stamped envelope
postmarked specifying "Winner’s List" or "Rules Request" to: “OurStage / JetBlue Live
From T5 Contest,” P.O. Box 182, Chelmsford, MA 01824. Vermont and Washington
residents may omit return postage.
